Article L1233-53 of the French Labour Code

In undertakings with fewer than fifty employees, the administrative authority shall verify, within twenty-one days from the date of notification of the proposed redundancy, that:

1° Staff representatives have been informed, convened and consulted in accordance with the legal and contractual provisions in force;

2° The obligations relating to the elaboration of social measures provided for by article L. 1233-32 or by collective labour agreements have been respected;

3° The measures provided for in article L. 1233-32 will be effectively implemented.

Dans les entreprises de moins de cinquante salariés, l’autorité administrative vérifie, dans le délai de vingt et un jours à compter de la date de la notification du projet de licenciement, que :

1° Les représentants du personnel ont été informés, réunis et consultés conformément aux dispositions légales et conventionnelles en vigueur ;

2° Les obligations relatives à l’élaboration des mesures sociales prévues par l’article L. 1233-32 ou par des conventions ou accords collectifs de travail ont été respectées ;

3° Les mesures prévues à l’article L. 1233-32 seront effectivement mises en oeuvre.
