Article L1233-57-3 of the French Labour Code

In the absence of a collective agreement or in the event of an agreement not covering all of the points mentioned in 1° to 5° of article L. 1233-24-2, the administrative authority shall approve the document drawn up by the employer mentioned in article L. 1233-24-4, after verifying that its content complies with the legislative provisions and the stipulations of the agreement relating to the items mentioned in 1° to 5° of article L. 1233-24-2, the regularity of the procedure for informing and consulting the social and economic committee, compliance, where applicable, with the obligations set out in Articles L. 1233-57-9 to L. 1233-57-16, L. 1233-57-19 and L. 1233-57-20 and compliance by the employment safeguard plan with Articles L. 1233-61 to L. 1233-63 based on the following criteria:

1° The resources available to the company, the economic and social unit and the group ;

2° The support measures planned in view of the scale of the redundancy project;

3° The training and adaptation efforts mentioned in articles L. 1233-4 and L. 6321-1.

It ensures that the employer has provided for recourse to the professional security contract mentioned in article L. 1233-65 or the implementation of the redeployment leave mentioned in article L. 1233-71.

Article L1233-57-3

En l’absence d’accord collectif ou en cas d’accord ne portant pas sur l’ensemble des points mentionnés aux 1° à 5° de l’article L. 1233-24-2, l’autorité administrative homologue le document élaboré par l’employeur mentionné à l’article L. 1233-24-4, après avoir vérifié la conformité de son contenu aux dispositions législatives et aux stipulations conventionnelles relatives aux éléments mentionnés aux 1° à 5° de l’article L. 1233-24-2, la régularité de la procédure d’information et de consultation du comité social et économique, le respect, le cas échéant, des obligations prévues aux articles L. 1233-57-9 à L. 1233-57-16, L. 1233-57-19 et L. 1233-57-20 et le respect par le plan de sauvegarde de l’emploi des articles L. 1233-61 à L. 1233-63 en fonction des critères suivants :

1° Les moyens dont disposent l’entreprise, l’unité économique et sociale et le groupe ;

2° Les mesures d’accompagnement prévues au regard de l’importance du projet de licenciement ;

3° Les efforts de formation et d’adaptation tels que mentionnés aux articles L. 1233-4 et L. 6321-1.

Elle s’assure que l’employeur a prévu le recours au contrat de sécurisation professionnelle mentionné à l’article L. 1233-65 ou la mise en place du congé de reclassement mentionné à l’article L. 1233-71.
