Article L1235-3 of the French Labour Code

If an employee is dismissed for a reason that is not genuine and serious, the judge may propose that the employee be reinstated in the company, while retaining his or her acquired benefits.

If either party refuses this reinstatement, the judge will award the employee compensation payable by the employer, the amount of which is between the minimum and maximum amounts set out in the table below.

In the event of redundancy in a company usually employing fewer than eleven employees, the minimum amounts set out below shall apply, notwithstanding those set out in the previous paragraph:

To determine the amount of compensation, the judge may take into account any redundancy payments made in connection with the termination of the contract, with the exception of the redundancy payment referred to in article L. 1234-9.

This indemnity may be combined, where applicable, with the indemnities provided for in Articles L. 1235-12, L. 1235-13 and L. 1235-15, subject to the maximum amounts provided for in this Article.

Si le licenciement d’un salarié survient pour une cause qui n’est pas réelle et sérieuse, le juge peut proposer la réintégration du salarié dans l’entreprise, avec maintien de ses avantages acquis.

Si l’une ou l’autre des parties refuse cette réintégration, le juge octroie au salarié une indemnité à la charge de l’employeur, dont le montant est compris entre les montants minimaux et maximaux fixés dans le tableau ci-dessous.

En cas de licenciement opéré dans une entreprise employant habituellement moins de onze salariés, les montants minimaux fixés ci-dessous sont applicables, par dérogation à ceux fixés à l’alinéa précédent :

Pour déterminer le montant de l’indemnité, le juge peut tenir compte, le cas échéant, des indemnités de licenciement versées à l’occasion de la rupture, à l’exception de l’indemnité de licenciement mentionnée à l’article L. 1234-9.

Cette indemnité est cumulable, le cas échéant, avec les indemnités prévues aux articles L. 1235-12, L. 1235-13 et L. 1235-15, dans la limite des montants maximaux prévus au présent article.
