Article L1235-7-1 of the French Labour Code

The collective agreement mentioned in article L. 1233-24-1, the document drawn up by the employer mentioned in article L. 1233-24-4, the content of the job protection plan, the decisions taken by the administration under article L. 1233-57-5 and the regularity of the collective redundancy procedure may not be the subject of a dispute separate from that relating to the validation or approval decision mentioned in article L. 1233-57-4.

These disputes fall under the jurisdiction, in the first instance, of the administrative court, to the exclusion of any other administrative or contentious appeal.

The appeal is lodged within two months by the employer as from the notification of the validation or approval decision, and by the trade union organisations and the employees as from the date on which this decision was brought to their attention in accordance with article L. 1233-57-4.

The administrative court shall rule within three months. If, at the end of this period, it has not given a ruling or in the event of an appeal, the dispute is referred to the Administrative Court of Appeal, which gives a ruling within a period of three months. If, at the end of this period, it has not given a ruling or in the event of an appeal to the Supreme Court, the dispute is referred to the Conseil d’Etat.

Book V of the Code of Administrative Justice is applicable.

L’accord collectif mentionné à l’article L. 1233-24-1, le document élaboré par l’employeur mentionné à l’article L. 1233-24-4, le contenu du plan de sauvegarde de l’emploi, les décisions prises par l’administration au titre de l’article L. 1233-57-5 et la régularité de la procédure de licenciement collectif ne peuvent faire l’objet d’un litige distinct de celui relatif à la décision de validation ou d’homologation mentionnée à l’article L. 1233-57-4.

Ces litiges relèvent de la compétence, en premier ressort, du tribunal administratif, à l’exclusion de tout autre recours administratif ou contentieux.

Le recours est présenté dans un délai de deux mois par l’employeur à compter de la notification de la décision de validation ou d’homologation, et par les organisations syndicales et les salariés à compter de la date à laquelle cette décision a été portée à leur connaissance conformément à l’article L. 1233-57-4.

Le tribunal administratif statue dans un délai de trois mois. Si, à l’issue de ce délai, il ne s’est pas prononcé ou en cas d’appel, le litige est porté devant la cour administrative d’appel, qui statue dans un délai de trois mois. Si, à l’issue de ce délai, elle ne s’est pas prononcée ou en cas de pourvoi en cassation, le litige est porté devant le Conseil d’Etat.

Le livre V du code de justice administrative est applicable.
