Article L124-3 of the French Insurance Code

The injured third party has a direct right of action against the insurer covering the civil liability of the person liable.

The insurer may not pay to anyone other than the injured party all or part of the sum owed by it, until the injured party has been reimbursed, up to the amount of the said sum, for the pecuniary consequences of the harmful event which gave rise to the liability of the insured.

Le tiers lésé dispose d’un droit d’action directe à l’encontre de l’assureur garantissant la responsabilité civile de la personne responsable.

L’assureur ne peut payer à un autre que le tiers lésé tout ou partie de la somme due par lui, tant que ce tiers n’a pas été désintéressé, jusqu’à concurrence de ladite somme, des conséquences pécuniaires du fait dommageable ayant entraîné la responsabilité de l’assuré.
