Article L124-4 of the French Insurance Code

In the case provided for in article L. 25-1 of the Highway Code, as stated in that article, “the insurer of the owner of the vehicle is obliged to guarantee, within the limits of the contract, compensation for the damage caused to the third party, subject to recourse, if necessary, against the public authority which, by its act, caused the damage giving rise to the insurer’s liability, and without any increase in premium for the owner as a result. This recourse, as well as any liability action for failure to insure the vehicle, shall be decided in accordance with the conditions set out inarticle 1 of law no. 57-1424 of 31 December 1957”.

Article L124-4

Dans le cas prévu par l’article L. 25-1 du Code de la route, comme il est dit à cet article, “l’assureur du propriétaire du véhicule est tenu de garantir dans les limites du contrat la réparation du dommage causé au tiers sauf recours, s’il y a lieu, contre la collectivité publique qui, par son fait, a causé le dommage ayant donné lieu à la responsabilité de l’assureur et sans qu’une majoration de prime puisse en résulter pour le propriétaire. Il est statué sur ce recours ainsi que sur toute action en responsabilité en cas de non-assurance du véhicule dans les conditions prévues par l’article 1er de la loi n° 57-1424 du 31 décembre 1957”.
