Article L1243-9 of the French Labour Code

With a view to improving vocational training for employees with fixed-term employment contracts, an extended branch collective agreement or agreement or a company or establishment agreement or agreement may also provide for the amount of the end-of-contract indemnity to be limited to 6%, provided that compensatory measures are offered to these employees, in particular in the form of preferential access to vocational training. In this case, the agreement or contract may stipulate the conditions under which these employees may undergo a skills assessment outside of their actual working time. This skills assessment is carried out as part of the training plan.

En vue d’améliorer la formation professionnelle des salariés titulaires de contrat de travail à durée déterminée, une convention ou un accord collectif de branche étendu ou une convention ou un accord d’entreprise ou d’établissement peut également prévoir de limiter le montant de l’indemnité de fin de contrat à hauteur de 6 %, dès lors que des contreparties sont offertes à ces salariés, notamment sous la forme d’un accès privilégié à la formation professionnelle. Dans ce cas, la convention ou l’accord peut prévoir les conditions dans lesquelles ces salariés peuvent suivre, en dehors du temps de travail effectif, un bilan de compétences. Ce bilan de compétences est réalisé dans le cadre du plan de formation.
