Article L1245-4 of the French Public Health Code

For the purposes of this Title, samples taken for grafting or administration in the context of research involving the human person within the meaning of Article L. 1121-1 are considered to be samples taken for therapeutic purposes, without prejudice to the provisions of Title II of Book I of this Part relating to the protection of persons who undergo research involving the human person.

In the case of research involving the human person relating to the cell therapy preparations mentioned in article L. 1243-1 and to tissues and their derivatives, the authorisation to conduct the research also constitutes authorisation, for this research, of the places of removal, storage, preparation and administration or grafting mentioned in articles L. 1242-1, L. 1243-2 and L. 1243-6 and it constitutes authorisation for import and export mentioned in article L. 1245-5.

Pour l’application du présent titre, les prélèvements pratiqués à fins de greffe ou d’administration dans le cadre des recherches impliquant la personne humaine au sens de l’article L. 1121-1 sont regardés comme des prélèvements à des fins thérapeutiques, sans préjudice des dispositions du titre II du livre Ier de la présente partie relatives à la protection des personnes qui se prêtent à des recherches impliquant la personne humaine.

Dans le cas des recherches impliquant la personne humaine portant sur les préparations de thérapie cellulaire mentionnées à l’article L. 1243-1 et sur les tissus et leurs dérivés, l’autorisation de mener la recherche vaut également autorisation, pour cette recherche, des lieux de prélèvement, de conservation, de préparation et d’administration ou de greffe mentionnés aux articles L. 1242-1, L. 1243-2 et L. 1243-6 et elle vaut autorisation d’importation et d’exportation mentionnée à l’article L. 1245-5.
