Article L1251-33 of the French Labour Code

The end-of-assignment indemnity is not due:

1° When the assignment contract is concluded under 3° of article L. 1251-6 if an extended collective agreement between the professional organisations of employers and employees in the temporary work branch, or if an agreement or arrangement concluded within the companies or establishments in this branch so provides ;

2° When the assignment contract is concluded under Article L. 1251-57;

3° (Repealed) ;

4° In the event of early termination of the contract at the employee’s initiative, through gross misconduct or in the event of force majeure.

Article L1251-33

L’indemnité de fin de mission n’est pas due :

1° Lorsque le contrat de mission est conclu au titre du 3° de l’article L. 1251-6 si un accord collectif étendu entre les organisations professionnelles d’employeurs et de salariés de la branche du travail temporaire, ou si une convention ou un accord conclu au sein d’entreprises ou d’établissements de cette branche le prévoit ;

2° Lorsque le contrat de mission est conclu dans le cadre de l’article L. 1251-57 ;

3° (Abrogé) ;

4° En cas de rupture anticipée du contrat à l’initiative du salarié, à sa faute grave ou en cas de force majeure.
