Article L1251-36-1 of the French Labour Code

In the absence of a stipulation in the branch agreement or agreement concluded pursuant toArticle L. 1251-36, this waiting period is equal to:

1° One third of the duration of the assignment contract that has expired if the duration of the contract, including, where applicable, its renewal(s), is fourteen days or more;

2° Half of the duration of the assignment contract that has expired if the duration of the contract, including, where applicable, its renewal(s), is less than fourteen days.

The days taken into account to determine the period between the two contracts are the days on which the user company or establishment is open.

A défaut de stipulation dans la convention ou l’accord de branche conclu en application de l’article L. 1251-36, ce délai de carence est égal :


1° Au tiers de la durée du contrat de mission venu à expiration si la durée du contrat incluant, le cas échéant, son ou ses renouvellements, est de quatorze jours ou plus ;


2° A la moitié de la durée du contrat de mission venu à expiration si la durée du contrat incluant, le cas échéant, son ou ses renouvellements, est inférieure à quatorze jours.


Les jours pris en compte pour apprécier le délai devant séparer les deux contrats sont les jours d’ouverture de l’entreprise ou de l’établissement utilisateurs.
