Article L1251-61 of the French Labour Code

Employees made available by a temporary employment agency to a public legal entity are subject to the rules governing the organisation and operation of the department in which they work and to the obligations imposed on all public employees. They benefit from the protection provided by article 11 of law no. 83-634 of 13 July 1983 on the rights and obligations of civil servants.

They may not be entrusted with duties that may expose them to the penalties provided for in articles 432-12 and 432-13 of the French Criminal Code.

Les salariés mis à disposition par une entreprise de travail temporaire auprès d’une personne morale de droit public sont soumis aux règles d’organisation et de fonctionnement du service où ils servent et aux obligations s’imposant à tout agent public. Ils bénéficient de la protection prévue par l’article 11 de la loi n° 83-634 du 13 juillet 1983 portant droits et obligations des fonctionnaires.

Il ne peut leur être confié de fonctions susceptibles de les exposer aux sanctions prévues aux articles 432-12 et 432-13 du code pénal.
