Article L1252-1 of the French Labour Code

The purpose of timeshare is to make an employee available by a timeshare company to a user customer to carry out an assignment.

Each assignment gives rise to the conclusion of :

1° A provision contract between the timeshare company and the user client, known as the “user company”;

2° an employment contract, known as a “timeshare contract”, between the employee and his employer, the timeshare company.

Le recours au travail à temps partagé a pour objet la mise à disposition d’un salarié par une entreprise de travail à temps partagé au bénéfice d’un client utilisateur pour l’exécution d’une mission.

Chaque mission donne lieu à la conclusion :

1° D’un contrat de mise à disposition entre l’entreprise de travail à temps partagé et le client utilisateur dit ” entreprise utilisatrice ” ;

2° D’un contrat de travail, dit ” contrat de travail à temps partagé “, entre le salarié et son employeur, l’entreprise de travail à temps partagé.
