Article L1255-1 of the French Labour Code

Failure to comply with the provisions relating to the conditions under which temporary work is carried out, as set out in article L. 1251-2, is punishable by a fine of 3,750 euros.

A repeat offence is punishable by six months’ imprisonment and a fine of 7,500 euros.

The court may also order a ban on working as a temporary employment agency for a period of between two and ten years. Where this measure results in the dismissal of permanent staff, they are entitled, in addition to compensation in lieu of notice and redundancy pay, to the compensation provided for in articles L. 1235-2, L. 1235-3 or L. 1235-5.

Le fait de méconnaître les dispositions relatives aux conditions d’exercice de l’activité de travail temporaire, prévues à l’article L. 1251-2, est puni d’une amende de 3 750 euros.

La récidive est punie d’un emprisonnement de six mois et d’une amende de 7 500 euros.

La juridiction peut prononcer, en outre, l’interdiction d’exercer l’activité d’entrepreneur de travail temporaire pour une durée de deux à dix ans. Lorsque cette mesure entraîne le licenciement du personnel permanent, celui-ci a droit, en dehors de l’indemnité de préavis et de l’indemnité de licenciement, aux indemnités prévues aux articles L. 1235-2, L. 1235-3 ou L. 1235-5.
