Article L128-4 of the French Insurance Code

In the zones and sectors, as defined in article L. 515-16 of the Environment Code, delimited by a technological risk prevention plan approved under the conditions provided for in article L. 515-22 of the same code, the obligation set out in the first paragraph of article L. 128-2 of this code is not binding on insurance undertakings in respect of the assets mentioned in the same article, with the exception, however, of assets existing prior to the publication of this plan.

This obligation is also not imposed on insurance undertakings in respect of property built in breach of the administrative rules in force at the time they were put in place and intended to prevent damage caused by a technological disaster.

However, insurance undertakings may only evade this obligation at the time of the initial conclusion or renewal of the contract.

Article L128-4

Dans les zones et secteurs, tels que définis à l’article L. 515-16 du code de l’environnement, délimitées par un plan de prévention des risques technologiques approuvé dans les conditions prévues à l’article L. 515-22 du même code, l’obligation prévue au premier alinéa de l’article L. 128-2 du présent code ne s’impose pas aux entreprises d’assurance à l’égard des biens mentionnés au même article, à l’exception, toutefois, des biens existant antérieurement à la publication de ce plan.

Cette obligation ne s’impose pas non plus aux entreprises d’assurance à l’égard des biens immobiliers construits en violation des règles administratives en vigueur lors de leur mise en place et tendant à prévenir les dommages causés par une catastrophe technologique.

Les entreprises d’assurance ne peuvent toutefois se soustraire à cette obligation que lors de la conclusion initiale ou du renouvellement du contrat.
