Article L131-34 of the French Commercial code

The National Council, a non-profit organisation with legal personality, is responsible for :

1° Examining, at national level, questions relating to the exercise of the function of sworn goods broker and, where appropriate, giving the public authorities its opinion on these questions;

2° Giving its opinion to the appeal courts on applications for the functions of sworn goods broker;

3° Keeping up to date, at national level, the list of brokers registered with the courts of appeal, possibly grouping them by speciality;

4° Organising aptitude examinations;

5° Preventing and conciliating all disputes between sworn merchandise brokers as well as receiving complaints made against brokers and communicating them, where appropriate, to the public prosecutor with territorial jurisdiction.

Article L131-34
Le conseil national, établissement d’utilité publique doté de la personnalité morale, est chargé :


1° D’examiner, sur le plan national, les questions relatives à l’exercice de la fonction de courtier de marchandises assermenté et de donner, le cas échéant, aux pouvoirs publics son avis sur ces questions ;


2° De donner son avis aux cours d’appel sur les candidatures aux fonctions de courtier de marchandises assermenté ;


3° De tenir à jour, sur le plan national, la liste des courtiers inscrits auprès des cours d’appel en les regroupant éventuellement par spécialités ;


4° D’organiser les examens d’aptitude ;


5° De prévenir et concilier tous différends entre courtiers de marchandises assermentés ainsi que de recevoir les réclamations faites contre les courtiers et de les communiquer, le cas échéant, au procureur de la République territorialement compétent.
