Article L131-59 of the French Monetary and Financial Code

Actions for recourse by the bearer against the endorsers, the drawer and the other obligees shall be barred after six months from the expiry of the time limit for presentation.

Actions for recourse by the various persons liable for payment of a cheque against each other shall be time-barred after six months from the day on which the person liable repaid the cheque or from the day on which he himself was sued. An action by the bearer of the cheque against the drawee shall be barred after one year from the expiry of the time limit for presentation.

However, in the event of forfeiture or prescription, an action remains against the drawer who has not made provision or the other debtors who have been unjustly enriched.

Les actions en recours du porteur contre les endosseurs, le tireur et les autres obligés se prescrivent par six mois à partir de l’expiration du délai de présentation.

Les actions en recours des divers obligés au paiement d’un chèque les uns contre les autres se prescrivent par six mois à partir du jour où l’obligé a remboursé le chèque ou du jour où il a été lui-même actionné. L’action du porteur du chèque contre le tiré se prescrit par un an à partir de l’expiration du délai de présentation.

Toutefois, en cas de déchéance ou de prescription, il subsiste une action contre le tireur qui n’a pas fait provision ou les autres obligés qui se seraient enrichis injustement.
