Article L1311-9 of the French General Code of Local Authorities

Projects for property transactions referred to in article L. 1311-10 must be preceded, prior to any amicable agreement, by a request for an opinion from the competent State authority when they are pursued by local authorities, their groupings and their public establishments.

The provisions of the first paragraph do not apply to local public establishments approved to carry out credit transactions and to land consolidation associations and their unions.

Les projets d’opérations immobilières mentionnés à l’article L. 1311-10 doivent être précédés, avant toute entente amiable, d’une demande d’avis de l’autorité compétente de l’Etat lorsqu’ils sont poursuivis par les collectivités territoriales, leurs groupements et leurs établissements publics.

Les dispositions du premier alinéa ne sont pas applicables aux établissements publics locaux agréés pour réaliser des opérations de crédit et aux associations foncières de remembrement et à leurs unions.
