Article L132-28 of the French Insurance Code

I.-The intermediary referred to in Article L. 511-1 shall draw up agreements with the insurance or capitalisation undertakings offering individual insurance policies with surrender values, capitalisation policies and the policies referred to in Article L. 132-5-3 and Article L. 441-1 for which he carries out intermediation activities.

These agreements specify in particular

1° The conditions under which the intermediary referred to in Article L. 511-1 is required to submit advertising documents to the insurance or capitalisation undertaking prior to their distribution in order to check that they comply with the insurance or capitalisation contract and, where applicable, the notice or memorandum ;

2° The conditions under which the intermediary is provided by the insurance or capitalisation undertaking with the information required to assess all the characteristics of the contract.

II – A decree in the Conseil d’Etat will specify the terms and conditions for the application of I, in particular the cases and conditions in which the obligation to draw up agreements is not justified given the nature of the contracts or the way in which they are distributed.

I.-L’intermédiaire mentionné à l’article L. 511-1 établit des conventions avec les entreprises d’assurance ou de capitalisation proposant les contrats d’assurance individuels comportant des valeurs de rachat, les contrats de capitalisation, les contrats mentionnés à l’article L. 132-5-3 et à l’article L. 441-1 et en raison desquels il exerce son activité d’intermédiation.

Ces conventions prévoient notamment :

1° Les conditions dans lesquelles l’intermédiaire mentionné à l’article L. 511-1 est tenu de soumettre à l’entreprise d’assurance ou de capitalisation les documents à caractère publicitaire préalablement à leur diffusion afin de vérifier leur conformité au contrat d’assurance ou de capitalisation et, le cas échéant, à la notice ou note ;

2° Les conditions dans lesquelles sont mises à disposition de l’intermédiaire par l’entreprise d’assurance ou de capitalisation les informations nécessaires à l’appréciation de l’ensemble des caractéristiques du contrat.

II.-Un décret en Conseil d’Etat précise les modalités d’application du I, notamment les cas et conditions dans lesquels l’obligation d’établir des conventions n’est pas justifiée compte tenu de la nature des contrats ou de leur mode de distribution.
