Article L132-4-1 of the French Insurance Code

When guardianship has been opened in respect of the stipulator, the subscription or surrender of a life insurance contract and the designation or substitution of the beneficiary may only be carried out with the authorisation of the guardianship judge or the family council if it has been constituted. After the opening of a guardianship, these same acts may only be carried out with the assistance of the guardian.

By way of derogation from the first sentence of the first paragraph, no authorisation is required for the funeral finance packages referred to inarticle L. 2223-33-1 of the General Local Authorities Code taken out on the life of an adult under guardianship.

For the purposes of the first paragraph, where the beneficiary of the life insurance contract is the curator or guardian, he is deemed to be in conflict of interest with the protected person.

Acceptance of the benefit of a life insurance contract entered into less than two years before publication of the judgment opening the curatorship or guardianship of the stipulator may be cancelled on the sole proof that the incapacity was notorious or known to the co-contractor at the time the deeds were entered into.

Lorsqu’une tutelle a été ouverte à l’égard du stipulant, la souscription ou le rachat d’un contrat d’assurance sur la vie ainsi que la désignation ou la substitution du bénéficiaire ne peuvent être accomplis qu’avec l’autorisation du juge des tutelles ou du conseil de famille s’il a été constitué. Après l’ouverture d’une curatelle, ces mêmes actes ne peuvent être accomplis qu’avec l’assistance du curateur.

Par dérogation à la première phrase du premier alinéa, aucune autorisation n’est requise pour les formules de financement d’obsèques mentionnées à l’article L. 2223-33-1 du code général des collectivités territoriales souscrites sur la tête d’un majeur en tutelle.

Pour l’application du premier alinéa, lorsque le bénéficiaire du contrat d’assurance sur la vie est le curateur ou le tuteur, il est réputé être en opposition d’intérêts avec la personne protégée.

L’acceptation du bénéfice d’un contrat d’assurance sur la vie conclu moins de deux ans avant la publicité du jugement d’ouverture de la curatelle ou de la tutelle du stipulant peut être annulée sur la seule preuve que l’incapacité était notoire ou connue du cocontractant à l’époque où les actes ont été passés.
