Article L1321-5 of the French General Code of Local Authorities

When the previously competent local authority was the lessee of the assets made available, the local authority benefiting from the transfer of competencies succeeds to all of its rights and obligations. It is substituted for the previously competent local authority in contracts of any kind that the latter had concluded for the development, maintenance and conservation of the assets made available as well as for the operation of the services. The previously competent local authority acknowledges this substitution and notifies its co-contractors.

Lorsque la collectivité antérieurement compétente était locataire des biens mis à disposition, la collectivité bénéficiaire du transfert de compétences succède à tous ses droits et obligations. Elle est substituée à la collectivité antérieurement compétente dans les contrats de toute nature que cette dernière avait conclus pour l’aménagement, l’entretien et la conservation des biens mis à disposition ainsi que pour le fonctionnement des services. La collectivité antérieurement compétente constate cette substitution et la notifie à ses cocontractants.
