Article L1322-1 of the French Public Health Code

I. – Without prejudice to the provisions of article L. 214-1 of the Environment Code, natural mineral water is subject to recognition and authorisation by the State representative in the département for:

1° Exploitation of the spring ;

2° Conditioning the water;

3° Use for therapeutic purposes in a spa establishment ;

4° Distribution in public refreshment areas.

II. – Any significant change in the characteristics of the natural mineral water or any significant change in the conditions under which the spring is exploited must be the subject of a request for revision of the recognition or authorisation to exploit.

Article L1322-1

I. – Sans préjudice des dispositions de l’article L. 214-1 du code de l’environnement, l’eau minérale naturelle fait l’objet d’une reconnaissance et d’une autorisation par le représentant de l’Etat dans le département pour :

1° L’exploitation de la source ;

2° Le conditionnement de l’eau ;

3° L’utilisation à des fins thérapeutiques dans un établissement thermal ;

4° La distribution en buvette publique.

II. – Toute modification notable des caractéristiques de l’eau minérale naturelle ou tout changement notable des conditions d’exploitation de la source doit faire l’objet d’une demande de révision de la reconnaissance ou de l’autorisation d’exploitation.
