I. – The value date of a sum credited to the payee’s account may not be later than the business day on which the amount of the payment transaction is credited to the payee’s payment service provider’s account.
The payee’s payment service provider shall make the amount of the transaction available to the payee immediately after his own account has been credited, including for payment transactions taking place within one and the same payment service provider, where :
a) there is no conversion; or
b) there is a conversion between the euro and the currency of a Member State or between the currencies of two Member States.
The value date of the debit to the payer’s payment account may not be earlier than the day on which the amount of the payment transaction is debited from that account.
These provisions apply if one of the payment service providers involved in the transaction is located in mainland France, the overseas departments, the Department of Mayotte, Saint-Martin, Saint-Barthélemy or Saint-Pierre-et-Miquelon.
Any stipulation contrary to this I is deemed unwritten.
II. – When a natural person not acting for professional purposes deposits cash into an account with a payment service provider, in the currency of that account, the payment service provider shall ensure that the amount deposited is made available and given a value date as soon as the funds are received.
Where the payment is made by a person other than the person referred to in the previous paragraph, the amount paid shall be made available and given a value date at the latest on the working day following that on which the funds are received.
