A payment order executed in accordance with the unique identifier provided by the Payment Service User shall be deemed to be duly executed in respect of the payee designated by the unique identifier.
If the unique identifier provided by the Payment Service User is incorrect, the Payment Service Provider shall not be liable for the incorrect execution or non-execution of the payment transaction.
However, the payer’s payment service provider shall endeavour to recover the funds involved in the payment transaction. The payee’s payment service provider shall provide the payer’s payment service provider with all information necessary to recover the funds. If the payer’s payment service provider is unable to recover the funds involved in the payment transaction, it shall, at the payer’s request, make available to the payer any information in its possession which may document the payer’s legal action to recover the funds.
If the deposit account agreement or the payment services framework agreement so provides, the payment service provider may charge the payment service user a recovery fee.
If the Payment Service User provides information in addition to the unique identifier or the information defined in the deposit account agreement or the framework payment services agreement as necessary for the correct execution of the payment order, the Payment Service Provider shall only be liable for the execution of the payment transaction in accordance with the unique identifier provided by the Payment Service User.
