Article L1330-1 of the French Public procurement code

By way of derogation from Titles I and II, where a contract covers both services covered by Article 346 of the Treaty on the Functioning of the European Union and services covered by the ordinary law of contracts set out in Book I of Part Two, Book II relating to partnership contracts or Book III relating to defence or security contracts or the ordinary law of concession contracts set out in Book I of Part Three, the contract is subject respectively to the special legal regime applicable to other public contracts provided for in Book V of Part Two or to other concession contracts provided for in Book II of Part Three, provided that the award of a single contract is justified by objective reasons.

Par dérogation aux titres Ier et II, lorsqu’un contrat porte à la fois sur des prestations qui relèvent de l’article 346 du Traité sur le fonctionnement de l’Union européenne et des prestations qui relèvent du droit commun des marchés prévu au livre Ier de la deuxième partie, de son livre II relatif aux marchés de partenariat ou de son livre III relatif aux marchés de défense ou de sécurité ou du droit commun des contrats de concession prévu au livre Ier de la troisième partie, le contrat est soumis respectivement au régime juridique particulier applicable aux autres marchés publics prévu au livre V de la deuxième partie ou des autres contrats de concession prévu au livre II de la troisième partie, à condition que la passation d’un contrat unique soit justifiée par des raisons objectives.
