Article L1332-1 of the French Public Health Code

Any person who installs a public or private swimming pool, artificial bathing facility or bathing area for public use must make a declaration to the local town hall before opening.

This declaration, accompanied by supporting documentation, includes an undertaking that the swimming pool or bathing area complies with the health and safety standards set by the decrees mentioned in articles L. 1332-7 and L. 1332-8.

Each year, the municipality shall carry out a survey of all bathing waters within the meaning of article L. 1332-2, whether or not they are equipped, for the first time before the start of the first bathing season following a date set by decree. The municipality encourages public participation in this census.

Article L1332-1

Toute personne qui procède à l’installation d’une piscine, d’une baignade artificielle ou à l’aménagement d’une baignade, publique ou privée à usage collectif, doit en faire, avant l’ouverture, la déclaration à la mairie du lieu de son implantation.

Cette déclaration, accompagnée d’un dossier justificatif, comporte l’engagement que l’installation de la piscine ou l’aménagement de la baignade satisfait aux normes d’hygiène et de sécurité fixées par les décrets mentionnés aux articles L. 1332-7 et L. 1332-8.

La commune recense, chaque année, toutes les eaux de baignade au sens des dispositions de l’article L. 1332-2, qu’elles soient aménagées ou non, et cela pour la première fois avant le début de la première saison balnéaire qui suit une date fixée par décret. La commune encourage la participation du public à ce recensement.
