The person responsible for a bathing water is deemed to be the person who declares the bathing water in accordance with the provisions of article L. 1332-1, or, in the absence of a declarant, the commune or group of competent territorial authorities within whose territory the bathing water is located.
The person responsible for a bathing water, under the supervision of the representative of the State in the département :
– defines the length of the bathing season ;
– draws up, reviews and updates the bathing water profile, which includes, in particular, an inventory and assessment of possible sources of pollution of the bathing water likely to affect the health of bathers, and specifies actions aimed at preventing bathers’ exposure to pollution risks;
– establishes a quality monitoring programme for each bathing water before the start of each bathing season;
– takes the realistic and proportionate measures it considers appropriate to improve bathing water quality, prevent bathers’ exposure to pollution, reduce the risk of pollution and improve the bathing water classification;
– analyses bathing water quality;
– ensures the provision of regularly updated information to the public on bathing water quality and management, and encourages public participation in the implementation of the above provisions;
– informs the mayor of the duration of the bathing water season, its profile and the arrangements for public information and participation.
It is obliged to undergo health inspections organised by the Regional Health Agency under the conditions set out in this chapter and in accordance with the procedures defined in article L. 1321-5.
