Without prejudice to the exercise of the police powers belonging to the various administrative authorities, the use of a swimming pool or bathing water may be prohibited by the administrative authorities if the physical conditions in which it is set up or operates are detrimental to the health or safety of users and to public hygiene or sanitation, or if the installation does not comply with the standards laid down or has not been brought into compliance with these standards within the period determined by the administrative authorities.
The person responsible for the bathing water and the mayor, in a reasoned opinion, may decide on the preventive and temporary closure of the bathing site in the event of a danger likely to affect the health of bathers, subject to informing the public of the reasons for and duration of the closure.
In the event of non-compliance with the provisions of articles L. 1332-1, L. 1332-3, this article and articles L. 1332-7 and L. 1332-8, or with the regulations and individual decisions taken for their application, the representative of the State in the département, acting on a report from the Director General of the Regional Health Agency, will give formal notice to the person responsible for the swimming pool, artificial bathing area or bathing water concerned to comply within a specified period.
