Article L1332-4 of the French Public Health Code

Without prejudice to the exercise of the police powers belonging to the various administrative authorities, the use of a swimming pool or bathing water may be prohibited by the administrative authorities if the physical conditions in which it is set up or operates are detrimental to the health or safety of users and to public hygiene or sanitation, or if the installation does not comply with the standards laid down or has not been brought into compliance with these standards within the period determined by the administrative authorities.

The person responsible for the bathing water and the mayor, in a reasoned opinion, may decide on the preventive and temporary closure of the bathing site in the event of a danger likely to affect the health of bathers, subject to informing the public of the reasons for and duration of the closure.

In the event of non-compliance with the provisions of articles L. 1332-1, L. 1332-3, this article and articles L. 1332-7 and L. 1332-8, or with the regulations and individual decisions taken for their application, the representative of the State in the département, acting on a report from the Director General of the Regional Health Agency, will give formal notice to the person responsible for the swimming pool, artificial bathing area or bathing water concerned to comply within a specified period.

Sans préjudice de l’exercice des pouvoirs de police appartenant aux diverses autorités administratives, l’utilisation d’une piscine ou d’une eau de baignade peut être interdite par les autorités administratives si les conditions matérielles d’aménagement ou de fonctionnement portent atteinte à la santé ou à la sécurité des utilisateurs ainsi qu’à l’hygiène ou à la salubrité publique, ou si l’installation n’est pas conforme aux normes prévues ou n’a pas été mise en conformité avec celles-ci dans le délai déterminé par les autorités administratives.

Le responsable de l’eau de baignade et le maire par avis motivé peuvent décider de la fermeture préventive et temporaire du site de baignade en cas de danger susceptible d’affecter la santé des baigneurs, sous réserve d’informer le public des causes et de la durée de la fermeture.

En cas d’inobservation des dispositions prévues par les articles L. 1332-1, L. 1332-3, le présent article et les articles L. 1332-7 et L. 1332-8 ou des règlements et décisions individuelles pris pour leur application, le représentant de l’Etat dans le département sur le rapport du directeur général de l’agence régionale de santé met en demeure la personne responsable de la piscine, de la baignade artificielle ou de l’eau de baignade concernée d’y satisfaire dans un délai déterminé.
