Article L1333-11 of the French Public Health Code

Access to certain categories of sources mentioned in 1° of Article L. 1333-1, the transport of such sources or access to information relating to the means and measures implemented to protect against malicious acts are authorised by the person responsible for the nuclear activity, who may request a security opinion from the administrative authority.

The opinion is issued following an administrative enquiry, which may involve consultation of bulletin no. 2 of the criminal record and automated processing of personal data covered byarticle 31 of law no. 78-17 of 6 January 1978 relating to information technology, files and freedoms, with the exception of identification files.

The person concerned is informed of the administrative enquiry.

L’accès à certaines catégories de sources mentionnées au 1° de l’article L. 1333-1, le convoyage de celles-ci ou l’accès aux informations portant sur les moyens et mesures de protection mise en œuvre contre les actes de malveillance sont autorisés par le responsable de l’activité nucléaire, qui peut demander un avis de sécurité à l’autorité administrative.

L’avis est rendu à la suite d’une enquête administrative, qui peut donner lieu à la consultation du bulletin n° 2 du casier judiciaire et des traitements automatisés de données à caractère personnel relevant de l’article 31 de la loi n° 78-17 du 6 janvier 1978 relative à l’informatique, aux fichiers et aux libertés, à l’exception des fichiers d’identification.

La personne concernée est informée de l’enquête administrative dont elle fait l’objet.
