Article L1338-4 of the French Public Health Code

I.-Infringements of the regulations adopted in application of articles L. 1338-1 and L. 1338-2 are investigated and recorded by officers and agents of the judicial police in accordance with the Code of Criminal Procedure and by the agents mentioned in articles L. 1421-1 and L. 1435-7, State agents approved and commissioned by the Minister for Agriculture, the agents mentioned inarticle L. 172-1 of the Environmental Code and the environmental inspectors of local authorities authorised and sworn in under conditions laid down by decree in the Council of State. The reports drawn up by these officers and agents are authentic until proven otherwise. With the exception of environmental inspectors who act under the conditions defined in articles L. 172-1 to L. 172-17 of the Environmental Code, these agents have the powers defined in Book II of the Consumer Code.

II – The agents mentioned in article L. 511-3 and in 1° and 2° of I of article L. 511-22 of the Consumer Code are authorised to investigate and record breaches of the regulations adopted in application of articles L. 1338-2 and L. 1338-3, under the conditions set out in I of article L. 511-22 of the same code.

III – The agents mentioned in 1° to 6° and in the last paragraph of I of article L. 205-1 of the Rural and Maritime Fishing Code are authorised to investigate and record breaches of the regulations adopted in application of this chapter. To this end, they have the powers provided for in I of article L. 511-22 of the Consumer Code.

Article L1338-4

I.-Les infractions aux règlements pris en application des articles L. 1338-1 et L. 1338-2 sont recherchées et constatées par les officiers et les agents de police judiciaire conformément au code de procédure pénale et par les agents mentionnés aux articles L. 1421-1 et L. 1435-7, les agents de l’Etat agréés et commissionnés par le ministre chargé de l’agriculture, les agents mentionnés à l’article L. 172-1 du code de l’environnement et les inspecteurs de l’environnement des collectivités territoriales habilités et assermentés dans des conditions fixées par décret en Conseil d’Etat. Les procès-verbaux dressés par ces officiers et ces agents font foi jusqu’à preuve du contraire. A l’exception des inspecteurs de l’environnement qui agissent selon les conditions définies aux articles L. 172-1 à L. 172-17 du code de l’environnement, ces agents disposent des pouvoirs définis au livre II du code de la consommation.

II.-Les agents mentionnés à l’article L. 511-3 et aux 1° et 2° du I de l’article L. 511-22 du code de la consommation sont habilités à rechercher et constater les infractions aux règlements pris en application des articles L. 1338-2 et L. 1338-3, dans les conditions prévues au I de l’article L. 511-22 du même code.

III.-Les agents mentionnés aux 1° à 6° et au dernier alinéa du I de l’article L. 205-1 du code rural et de la pêche maritime ont qualité pour rechercher et constater les infractions aux règlements pris en application du présent chapitre. A cet effet, ils disposent des pouvoirs prévus au I de l’article L. 511-22 du code de la consommation.
