Article L1340-6 of the French Public Health Code

The conditions for the application of this chapter are determined by decree in the Conseil d’Etat, in particular :

1° The organisation of the toxicovigilance system ;

2° The conditions under which the confidentiality with regard to third parties of information covered by medical secrecy or industrial secrecy transmitted pursuant to articles L. 1340-4 and L. 1340-5 is preserved;

3° The conditions for sharing information between the bodies responsible for vigilance systems or for monitoring the state of health of the population in order to carry out these missions.

Les conditions d’application du présent chapitre sont déterminées par décret en Conseil d’Etat, notamment :

1° L’organisation du système de toxicovigilance ;

2° Les conditions dans lesquelles est préservée la confidentialité à l’égard des tiers des informations couvertes par le secret médical ou le secret industriel transmises en application des articles L. 1340-4 et L. 1340-5 ;

3° Les conditions de partage des informations entre les organismes responsables des systèmes de vigilance ou de surveillance de l’état de santé de la population pour l’exercice de ces missions.
