Article L141-4 of the French Insurance Code

The policyholder must :

– provide members with a notice drawn up by the insurer setting out the cover and the conditions under which it comes into force, as well as the formalities to be completed in the event of a claim;

– inform members in writing of changes to their rights and obligations, at least three months before the planned date of entry into force.

Proof of delivery of the notice to the member and of the information relating to contractual changes is the responsibility of the policyholder.

The subscriber may terminate his or her membership as a result of these changes.

However, the option of cancellation is not available to the member if the relationship between the member and the policyholder makes membership of the contract compulsory.

Group insurance policies whose purpose is to guarantee the repayment of a loan and which are governed by special laws are not subject to the provisions of this article.

Le souscripteur est tenu :

– de remettre à l’adhérent une notice établie par l’assureur qui définit les garanties et leurs modalités d’entrée en vigueur ainsi que les formalités à accomplir en cas de sinistre ;

– d’informer par écrit les adhérents des modifications apportées à leurs droits et obligations, trois mois au minimum avant la date prévue de leur entrée en vigueur.

La preuve de la remise de la notice à l’adhérent et de l’information relative aux modifications contractuelles incombe au souscripteur.

L’adhérent peut dénoncer son adhésion en raison de ces modifications.

Toutefois, la faculté de dénonciation n’est pas offerte à l’adhérent lorsque le lien qui l’unit au souscripteur rend obligatoire l’adhésion au contrat.

Les assurances de groupe ayant pour objet la garantie de remboursement d’un emprunt et qui sont régies par des lois spéciales ne sont pas soumises aux dispositions du présent article.
