The authorisation referred to in article L. 141-5 shall be refused, or where appropriate withdrawn, if the character or behaviour of the person concerned appears incompatible with the performance of the duties assigned to him/her. It may only be withdrawn by the administrative authority or by the public prosecutor after the person concerned has been given the opportunity to present his or her observations. However, it may be suspended immediately in an emergency.
In the context of any contract referred to in this section, the public authority may decide, generally or on a case-by-case basis, that the transport of certain persons, due to particular risks of escape or disturbance of public order, remains carried out by State agents, alone or in conjunction.
