Article L141-8 of the French Code governing the entry and residence of foreign nationals and the right of asylum

The authorisation referred to in article L. 141-5 shall be refused, or where appropriate withdrawn, if the character or behaviour of the person concerned appears incompatible with the performance of the duties assigned to him/her. It may only be withdrawn by the administrative authority or by the public prosecutor after the person concerned has been given the opportunity to present his or her observations. However, it may be suspended immediately in an emergency.
In the context of any contract referred to in this section, the public authority may decide, generally or on a case-by-case basis, that the transport of certain persons, due to particular risks of escape or disturbance of public order, remains carried out by State agents, alone or in conjunction.

Article L141-8

L’agrément mentionné à l’article L. 141-5 est refusé, ou le cas échéant retiré, lorsque la moralité ou le comportement de la personne concernée apparaissent incompatibles avec l’exercice des missions qui lui sont dévolues. Il ne peut être retiré par l’autorité administrative ou par le procureur de la République qu’après que l’intéressé a été mis en mesure de présenter ses observations. Il peut toutefois faire l’objet d’une suspension immédiate en cas d’urgence.
Dans le cadre de tout marché visé à la présente section, l’autorité publique peut décider, de manière générale ou au cas par cas, que le transport de certaines personnes, en raison de risques particuliers d’évasion ou de troubles à l’ordre public, demeure effectué par les agents de l’Etat, seuls ou en concours.
