Article L1414-2 of the French General Code of Local Authorities

For public contracts awarded in accordance with a formalised procedure, the estimated value of which, excluding tax, taken individually, is equal to or greater than the European thresholds listed in the appendix to the Public Order Code, with the exception of public contracts awarded by public social or medico-social establishments, the successful tenderer is chosen by a tender committee composed in accordance with the provisions of article L. 1411-5. However, for public contracts awarded by public housing offices, the tendering committee is governed by the provisions of the Construction and Housing Code applicable to the tendering committees of private low-cost housing bodies.

In the event of overriding urgency, the public contract may be awarded without a prior meeting of the tender committee.

The deliberations of the tender committee may be organised remotely under the conditions of Order No. 2014-1329 of 6 November 2014 on remote deliberations of administrative bodies of a collegiate nature.

Pour les marchés publics passés selon une procédure formalisée dont la valeur estimée hors taxe prise individuellement est égale ou supérieure aux seuils européens qui figurent en annexe du code de la commande publique, à l’exception des marchés publics passés par les établissements publics sociaux ou médico-sociaux, le titulaire est choisi par une commission d’appel d’offres composée conformément aux dispositions de l’article L. 1411-5. Toutefois, pour les marchés publics passés par les offices publics de l’habitat, la commission d’appel d’offres est régie par les dispositions du code de la construction et de l’habitation applicables aux commissions d’appel d’offres des organismes privés d’habitations à loyer modéré.

En cas d’urgence impérieuse, le marché public peut être attribué sans réunion préalable de la commission d’appel d’offres.

Les délibérations de la commission d’appel d’offres peuvent être organisées à distance dans les conditions de l’ordonnance n° 2014-1329 du 6 novembre 2014 relative aux délibérations à distance des instances administratives à caractère collégial.
