Article L1414-4 of the French General Code of Local Authorities

Any draft amendment to a public contract resulting in an increase of more than 5% in the overall amount shall be submitted to the tendering committee for its opinion. When the deliberative assembly is called upon to decide on a draft amendment, the opinion of the call for tenders committee is sent to it beforehand.

However, these provisions do not apply when these amendments concern public contracts that are not submitted to the call for tenders committee.

Article L1414-4

Tout projet d’avenant à un marché public entraînant une augmentation du montant global supérieure à 5 % est soumis pour avis à la commission d’appel d’offres. Lorsque l’assemblée délibérante est appelée à statuer sur un projet d’avenant, l’avis de la commission d’appel d’offres lui est préalablement transmis.

Toutefois, ces dispositions ne sont pas applicables lorsque ces avenants concernent des marchés publics qui ne sont pas soumis à la commission d’appel d’offres.
