Article L1453-13 of the French Public Health Code

A decree of the Conseil d’Etat shall determine the terms and conditions for the application of sections 3 and 4 of this chapter, and in particular:

1° The definition of the health services referred to in article L. 1453-5 ;

2° The content of the agreement provided for in article L. 1453-8 , in particular when it is concluded by the legal representative of a signatory structure or direct beneficiary of the benefit which benefits a non-signatory healthcare professional;

3° The declaration and authorisation procedures, in particular the competent administrative authority mentioned in articles L. 1453-10, L. 1453-12 and L. 1453-14, the deadline by which failure to respond to an application for authorisation will be deemed to constitute acceptance and the conditions under which refusals are notified, as well as the procedures for making the recommendations referred to in Article L. 1453-10;

4° Where the declaration or application for authorisation is addressed to a professional association, the conditions under which the latter transmits to the competent administrative authority the information gathered when examining the declaration or application for authorisation.

Article L1453-13

Un décret en Conseil d’Etat détermine les modalités d’application des sections 3 et 4 du présent chapitre et notamment :

1° La définition des prestations de santé mentionnées à l’article L. 1453-5 ;

2° Le contenu de la convention prévue à l’article L. 1453-8 notamment lorsqu’elle est conclue par le représentant légal d’une structure signataire ou bénéficiaire directe de l’avantage qui bénéficie à un professionnel de santé non signataire ;

3° Les procédures de déclaration et d’autorisation, notamment l’autorité administrative compétente mentionnée aux articles L. 1453-10, L. 1453-12 et L. 1453-14, le délai au terme duquel le défaut de réponse à une demande d’autorisation vaut acceptation et les conditions dans lesquelles les refus sont notifiés ainsi que les modalités selon lesquelles sont effectuées les recommandations mentionnées à l’article L. 1453-10 ;

4° Lorsque le destinataire de la déclaration ou de la demande d’autorisation est un ordre professionnel, les conditions selon lesquelles celui-ci transmet à l’autorité administrative compétente les informations recueillies à l’occasion de l’examen de la déclaration ou de la demande d’autorisation.
