Article L1613-5 of the French General Code of Local Authorities

Local authorities and establishments that make civil servants available to trade union organisations, under the conditions set out in article 100 of law no. 84-53 of 26 January 1984 on the statutory provisions relating to the local civil service, are reimbursed for the corresponding salary costs of all kinds by a special grant taken from the resources allocated to the overall operating grant by the finance law for the year. The amount of this special contribution is set each year by the Local Finance Committee taking into account the actual expenses resulting for the local authorities from the application of the provisions set out in article 100 of the aforementioned law no. 84-53 of 26 January 1984.

A decree in the Conseil d’Etat sets out the terms and conditions for the application of this article.

Les collectivités et établissements qui mettent des fonctionnaires à la disposition des organisations syndicales, dans les conditions prévues par l’article 100 de la loi n° 84-53 du 26 janvier 1984 portant dispositions statutaires relatives à la fonction publique territoriale, sont remboursés des charges salariales de toute nature correspondantes par une dotation particulière prélevée sur les ressources affectées à la dotation globale de fonctionnement par la loi de finances de l’année. Le montant de ce concours particulier est fixé chaque année par le comité des finances locales compte tenu des charges effectives résultant pour les collectivités territoriales de l’application des dispositions prévues à l’article 100 de la loi n° 84-53 du 26 janvier 1984 précitée.

Un décret en Conseil d’Etat fixe les modalités d’application du présent article.
