Article L172-3 of the French Insurance Code

Any change during the term of the contract, either to what was agreed when the contract was taken out, or to the insured object, which results in a significant increase in the risk, shall result in cancellation of the insurance if it has not been notified to the insurer within three days of the insured becoming aware of it, excluding public holidays, unless the insured provides proof of good faith, in which case the provisions of the second paragraph of article L. 172-2 shall apply.

If this increase is not the fault of the insured, the insurance continues, subject to an increase in the premium corresponding to the increase that has occurred.

If the worsening is the fault of the insured, the insurer may either cancel the contract within three days of becoming aware of the worsening, forfeiting the premium, or demand a premium increase corresponding to the worsening.

Toute modification en cours de contrat, soit de ce qui a été convenu lors de sa formation, soit de l’objet assuré, d’où résulte une aggravation sensible du risque, entraîne la résiliation de l’assurance si elle n’a pas été déclarée à l’assureur dans les trois jours où l’assuré en a eu connaissance, jours fériés non compris, à moins que celui-ci n’apporte la preuve de sa bonne foi, auquel cas il est fait application des dispositions du deuxième alinéa de l’article L. 172-2.

Si cette aggravation n’est pas le fait de l’assuré, l’assurance continue, moyennant augmentation de la prime correspondant à l’aggravation survenue.

Si l’aggravation est le fait de l’assuré, l’assureur peut, soit résilier le contrat dans les trois jours à partir du moment où il en a eu connaissance, la prime lui étant acquise, soit exiger une augmentation de prime correspondant à l’aggravation survenue.
