Article L173-25 of the French Insurance Code

Liability insurance, the purpose of which is to compensate for damage caused to third parties by the vessel and which is guaranteed under the terms of article L. 173-8, only takes effect if the sum insured by the hull policy is insufficient.

L’assurance de responsabilité, qui a pour objet la réparation des dommages causés aux tiers par le navire et qui sont garantis dans les termes de l’article L. 173-8, ne produit d’effet qu’en cas d’insuffisance de la somme assurée par la police sur corps.
