Article L2000-5 of the French Public procurement code

Where a purchaser decides to conclude a single public contract falling within the scope of Book I intended to meet a need relating to both its activities as a contracting authority and its activities as a contracting entity, the rules of Book I applicable are :
1° The rules applicable to contracting entities, where the need to be met is principally linked to the activity of the contracting entity;
2° The rules applicable to contracting authorities, where the need to be met is principally linked to the activity of the contracting authority or if it is impossible to determine for which activity the public contract is principally intended.

Lorsqu’un acheteur décide de conclure un marché public unique relevant du livre Ier destiné à répondre à un besoin concernant à la fois ses activités de pouvoir adjudicateur et ses activités d’entité adjudicatrice, les règles du livre Ier applicables sont :
1° Les règles applicables aux entités adjudicatrices, lorsque le besoin à satisfaire est principalement lié à l’activité d’entité adjudicatrice ;
2° Les règles applicables aux pouvoirs adjudicateurs, lorsque le besoin à satisfaire est principalement lié à l’activité de pouvoir adjudicateur ou s’il est impossible de déterminer à quelle activité ce marché public est principalement destiné.
