Article L211-5 of the French Monetary and Financial Code

The procedure for identifying the owners of equity securities is set out in Articles L. 228-2 to L. 228-3-6 of the Commercial Code.

The identification procedure referred to in the first paragraph applies to undertakings for collective investment, whether or not they have the form of a joint stock company, and may be carried out by their management company. For all such undertakings, this procedure is applicable, notwithstanding the absence of specific stipulations in the articles of association or by-laws.

La procédure d’identification des propriétaires de titres de capital est fixée aux articles L. 228-2 à L. 228-3-6 du code de commerce.

La procédure d’identification mentionnée au premier alinéa est applicable aux organismes de placement collectif, qu’ils aient ou non la forme de société par actions, et peut être exercée par leur société de gestion. Pour l’ensemble de ces organismes, cette procédure est applicable, nonobstant l’absence de stipulations spécifiques dans les statuts ou le règlement.
