Article L2112-2 of the French General Code of Local Authorities

Changes to the territorial boundaries of communes and the transfer of their chief towns are decided after a public enquiry, carried out in accordance with the code of relations between the public and the administration, in the communes concerned on the project itself and its conditions.

The representative of the State in the department prescribes this public enquiry, carried out in accordance with the code of relations between the public and the administration, when a request to this effect has been made to him either by the municipal council of one of the communes, or by one third of the registered voters in the commune or portion of territory in question. He may also order it ex officio.

The public enquiry, carried out in accordance with the code of relations between the public and the administration, is not compulsory in the case of a merger of communes.

If the request concerns the detachment of a section of a commune or a portion of the territory of a commune in order to establish it as a separate commune, it must, in order to be admissible, be confirmed at the end of a period of one year.

Les modifications aux limites territoriales des communes et le transfert de leurs chefs-lieux sont décidés après enquête publique, réalisée conformément au code des relations entre le public et l’administration, dans les communes intéressées sur le projet lui-même et sur ses conditions.

Le représentant de l’Etat dans le département prescrit cette enquête publique, réalisée conformément au code des relations entre le public et l’administration, lorsqu’il a été saisi d’une demande à cet effet soit par le conseil municipal de l’une des communes, soit par le tiers des électeurs inscrits de la commune ou de la portion de territoire en question. Il peut aussi l’ordonner d’office.

L’enquête publique, réalisée conformément au code des relations entre le public et l’administration, n’est pas obligatoire s’il s’agit d’une fusion de communes.

Si la demande concerne le détachement d’une section de commune ou d’une portion du territoire d’une commune pour l’ériger en commune séparée, elle doit, pour être recevable, être confirmée à l’expiration d’un délai d’une année.
