Article L2112-5-1 of the French General Code of Local Authorities

In the event that a portion of a commune is erected as a separate commune, the new commune automatically becomes a member of the public establishments for inter-communal cooperation to which the commune from which it has been detached belonged, unless other establishments are designated in the decree provided for in Article L. 2112-5. The new municipality’s participation in these establishments is governed by the provisions of the present code. In the event of the designation of other establishments, the withdrawal of the original establishment is carried out in accordance with the conditions set out in article L. 5211-25-1.

Dans le cas où une portion de commune est érigée en commune distincte, la nouvelle commune devient membre de plein droit des établissements publics de coopération intercommunale auxquels appartenait la commune dont elle a été détachée, sauf en cas de désignation d’autres établissements dans l’arrêté prévu à l’article L. 2112-5. La participation de la nouvelle commune auxdits établissements se fait selon les dispositions prévues dans le présent code. En cas de désignation d’autres établissements, le retrait de l’établissement d’origine s’effectue dans les conditions fixées par l’article L. 5211-25-1.
