Article L212-3-2 of the French Intellectual Property Code

In the absence of a specific provision in his exploitation contract or a collective or professional agreement applicable in his sector of activity and providing for a comparable mechanism, the performer is entitled to additional remuneration when the remuneration initially provided for in the exploitation contract proves to be excessively low in relation to the total income subsequently derived from the exploitation by the assignee. In order to assess the performer’s situation, his or her contribution may be taken into account.

The application for review is made by the performer.
The request for review shall be made by the performer or any person specially authorised by him/her for this purpose.

These provisions are without prejudice to other provisions laid down in this code.

En l’absence de disposition particulière prévue dans son contrat d’exploitation ou d’accord collectif ou professionnel applicable dans son secteur d’activité et prévoyant un mécanisme comparable, l’artiste-interprète a droit à une rémunération supplémentaire lorsque la rémunération initialement prévue dans le contrat d’exploitation se révèle exagérément faible par rapport à l’ensemble des revenus ultérieurement tirés de l’exploitation par le cessionnaire. Afin d’évaluer la situation de l’artiste-interprète, il peut être tenu compte de sa contribution.


La demande de révision est faite par l’artiste-interprète ou toute personne spécialement mandatée par lui à cet effet.


Ces dispositions sont sans préjudice d’autres dispositions prévues par le présent code.
