Article L2121-5 of the French General Code of Local Authorities

Any member of a town council who, without a valid excuse, has refused to carry out one of the duties devolved upon him by the laws, shall be declared to have resigned by the administrative court.

The refusal results either from an express declaration addressed to whom it may concern or made public by its author, or from persistent abstention after warning by the authority responsible for convening.

The member thus resigning may not be re-elected before the period of one year.

Tout membre d’un conseil municipal qui, sans excuse valable, a refusé de remplir une des fonctions qui lui sont dévolues par les lois, est déclaré démissionnaire par le tribunal administratif.

Le refus résulte soit d’une déclaration expresse adressée à qui de droit ou rendue publique par son auteur, soit de l’abstention persistante après avertissement de l’autorité chargée de la convocation.

Le membre ainsi démissionnaire ne peut être réélu avant le délai d’un an.
