Article L2122-9 of the French General Code of Local Authorities

In communes of 1,000 inhabitants or more, when it is necessary to elect a new mayor, the municipal council is deemed to be complete if the only vacancies that exist within it are the consequence of:

<1° Resignations given when the mayor has ceased to hold office and before the election of his successor;

2° A decision of the administrative court that has become final annulling the election of municipal councillors without the concomitant proclamation of other elected members.

Dans les communes de 1 000 habitants et plus, lorsqu’il y a lieu de procéder à l’élection d’un nouveau maire, le conseil municipal est réputé complet si les seules vacances qui existent en son sein sont la conséquence :

1° De démissions données lorsque le maire a cessé ses fonctions et avant l’élection de son successeur ;

2° D’une décision de la juridiction administrative devenue définitive annulant l’élection de conseillers municipaux sans proclamation concomitante d’autres élus.
