Article L2123-23 of the French General Code of Local Authorities

Mayors of communes or chairmen of special delegations receive a functional allowance set by applying the reference term mentioned in article L. 2123-20 the following scale:

The municipal council may, by deliberation, set a functional allowance lower than the above scale, at the mayor’s request.

The functional allowance paid to the mayors of municipalities with a population of 100,000 or more may be increased by 40% of the scale provided for in the second paragraph, provided that the total amount of the maximum allowances likely to be allocated to the members of the municipal council without taking account of the said increase is not exceeded.

Les maires des communes ou les présidents de délégations spéciales perçoivent une indemnité de fonction fixée en appliquant au terme de référence mentionné à l’article L. 2123-20 le barème suivant :

Le conseil municipal peut, par délibération, fixer une indemnité de fonction inférieure au barème ci-dessus, à la demande du maire.

L’indemnité de fonction versée aux maires des communes de 100 000 habitants et plus peut être majorée de 40 % du barème prévu au deuxième alinéa, à condition que ne soit pas dépassé le montant total des indemnités maximales susceptibles d’être allouées aux membres du conseil municipal hors prise en compte de ladite majoration.
