Article L2123-27 of the French General Code of Local Authorities

Elected representatives who receive an official allowance pursuant to the provisions of this code or any other provision governing compensation for their duties may set up an annuity pension in the management of which the affiliated elected representatives must participate.

The constitution of this annuity is half the responsibility of the elected member and half the responsibility of the municipality.

A decree in the Council of State sets the maximum contribution rates.

Les élus qui perçoivent une indemnité de fonction en application des dispositions du présent code ou de toute autre disposition régissant l’indemnisation de leurs fonctions peuvent constituer une retraite par rente à la gestion de laquelle doivent participer les élus affiliés.

La constitution de cette rente incombe pour moitié à l’élu et pour moitié à la commune.

Un décret en Conseil d’Etat fixe le plafond des taux de cotisation.
