Article L2124-3 of the French General Code of Local Authorities

In times of war, the representative of the State in the department may, by himself or by a special delegate, take a measure of communal interest by substituting himself for the mayor who, despite formal notice, has neglected or refused to take it.

When the measure to be taken is of inter-communal interest, the representative of the State in the department may substitute himself under the same conditions for the mayors of the communes concerned or, if the measure falls by its object within the remit of a public establishment for inter-communal cooperation, for the president of this establishment.

En temps de guerre, le représentant de l’Etat dans le département peut, par lui-même ou par un délégué spécial, prendre une mesure d’intérêt communal en se substituant au maire qui, malgré une mise en demeure, a négligé ou refusé de la prendre.

Lorsque la mesure à prendre présente un intérêt intercommunal, le représentant de l’Etat dans le département peut se substituer dans les mêmes conditions aux maires des communes intéressées ou, si la mesure rentre par son objet dans les attributions d’un établissement public de coopération intercommunale, au président de cet établissement.
