Article L2171-4 of the French Public procurement code

The State may entrust an economic operator with a comprehensive assignment covering :

1° The design, construction, fitting out, upkeep and maintenance of buildings assigned to the national police force, the national gendarmerie, the armed forces or departments of the Ministry of Defence, the Paris fire brigade or assigned by the State to the training of personnel involved in civil defence and security missions;

2° Designing, building and fitting out the infrastructure required to set up communication and information systems that meet the needs of the Ministry of the Interior’s departments;

3° The design, construction and fitting out of prisons. This mission may also include the operation or maintenance of prisons, with the exception of management, registry and surveillance functions;

4° The design, construction, fitting out, upkeep, hotel management and maintenance of detention centres or waiting areas. This mission may not entail entrusting the registration and surveillance of detainees or persons being held to persons other than State employees;

5° The design, construction, development, operation, maintenance or upkeep of the State’s linear transport infrastructures, excluding buildings.

L’Etat peut confier à un opérateur économique une mission globale portant sur :

1° La conception, la construction, l’aménagement, l’entretien et la maintenance des immeubles affectés à la police nationale, à la gendarmerie nationale, aux armées ou aux services du ministère de la défense, à la brigade des sapeurs-pompiers de Paris ou affectés par l’Etat à la formation des personnels qui concourent aux missions de défense et de sécurité civiles ;

2° La conception, la construction et l’aménagement des infrastructures nécessaires à la mise en place de systèmes de communication et d’information répondant aux besoins des services du ministère de l’intérieur ;

3° La conception, la construction et l’aménagement des établissements pénitentiaires. Cette mission peut en outre porter sur l’exploitation ou la maintenance des établissements pénitentiaires, à l’exception des fonctions de direction, de greffe et de surveillance ;

4° La conception, la construction, l’aménagement, l’entretien, l’hôtellerie et la maintenance de centres de rétention ou de zones d’attente. Cette mission ne peut conduire à confier l’enregistrement et la surveillance des personnes retenues ou maintenues à d’autres personnes que des agents de l’Etat ;

5° La conception, la construction, l’aménagement, l’exploitation, la maintenance ou l’entretien des infrastructures linéaires de transport de l’Etat, hors bâtiments.
