Article L2171-6 of the French Public procurement code

I. – Société du Grand Paris may award an overall contract to an economic operator for all or part of the design, construction and development of the infrastructure of the Greater Paris public transport network within the meaning of II of Article 7 of Law no. 2010-597 of 3 June 2010 on Greater Paris, or of the public transport infrastructure for which it is responsible, on construction and property development operations not directly linked to the aforementioned infrastructures that fall within its remit, as well as on the maintenance of elements that are handed over to Ile-de-France Mobilités in application of articles 20 and 20-2 of the aforementioned law no. 2010-597 of 3 June 2010.

II. – By decision of the Société du Grand Paris, and in accordance with the specific terms set out in the consultation documents, the economic operator awarded the contract relating to the overall task mentioned in I of this article may, with the agreement of the co-contractor concerned, have the rights and obligations arising from all or part of the contracts awarded by the Société du Grand Paris and which may contribute to the performance of its task transferred to it. The contract relating to the overall task then incorporates the aforementioned rights and obligations and the composition of the successful economic operator is modified to include the contract holder whose rights and obligations are thus transferred.

The contract referred to in I above may entrust the contractor with the acquisition of goods required for the project. In this case, the contractor transfers the assets acquired to Société du Grand Paris under the conditions defined by the contract.

Article L2171-6

I. – La Société du Grand Paris peut confier à un opérateur économique une mission globale portant sur tout ou partie de la conception, de la construction et de l’aménagement des infrastructures du réseau de transport public du Grand Paris au sens du II de l’article 7 de la loi n° 2010-597 du 3 juin 2010 relative au Grand Paris ou des infrastructures de transport public dont la maîtrise d’ouvrage lui est confiée, sur les opérations de construction et de valorisation immobilière non directement liées aux infrastructures précitées qui relèvent de sa compétence ainsi que sur la maintenance des éléments qui sont remis en gestion à Ile-de-France Mobilités en application des articles 20 et 20-2 de la loi n° 2010-597 du 3 juin 2010 précitée.

II. – Sur décision de la Société du Grand Paris, et selon les modalités particulières prévues par les documents de la consultation, l’opérateur économique attributaire du contrat relatif à la mission globale mentionnée au I du présent article peut se voir transférer, avec l’accord du cocontractant concerné, les droits et obligations issus de tout ou partie des marchés passés par la Société du Grand Paris et pouvant concourir à l’exécution de sa mission. Le contrat portant sur la mission globale intègre alors les droits et obligations précités et la composition de l’opérateur économique attributaire est modifiée afin d’inclure le titulaire du marché dont les droits et obligations sont ainsi transférés.

Le marché mentionné au même I peut confier au titulaire l’acquisition de biens nécessaires à la réalisation de l’opération. Dans ce cadre, le titulaire remet les biens acquis à la Société du Grand Paris dans les conditions définies par ce marché.
